Appellate Court Upholds $1.8 Million Judgment in Medical Malpractice Case

A Texas appellate court has upheld the $1.8 million judgment awarded in a 2013 medical malpractice lawsuit handled by The Law Office of Michael Pezzulli.
The Fifth Court of Appeals in Dallas denied the doctor’s challenges to the timing and evidence in
Chang, M.D. v. Ashley Denny. In the lawsuit, the 401st District Court trial jury found Dr. Chang negligent for leaving a cotton ball inside a patient’s brain that caused her permanent injury. The jury determined the claim had been prosecuted with diligence after the injury was discovered, and awarded Denny monetary damages for her loss of earning capacity. All issues were upheld by the appellate court.
